Limited Wear/Durability Warranty
What is covered?
Beaulieu warrants that when properly installed in compliance with CRI standards, the pile yarn in any area of your carpet will not experience excessive wear during the duration of the warranty period specified on your authorized Beaulieu carpet dealer’s sample. Excessive wear is defined as a countable loss of pile fiber, of 10% or greater resulting from normal foot traffic, and is determined by pile yarn weight comparison of the worn area of your carpet to non-trafficked areas, or by testing using mechanical wear simulators. What Is Not Covered?” 11 Limited Texture Retention Warranty What is covered? Beaulieu warrants that your carpet will not exhibit abnormal texture loss resulting from normal foot traffic during the warranty period specified on your authorized Beaulieu carpet dealer’s sample . When properly installed using carpet cushion meeting our requirements, and properly maintained as specified, texture retention is the ability of carpet tus to retain a normal amount of their visible size, shape and orientation. is includes the ability of cut pile carpet tus not to burst, bloom, open or lose twist excessively. Texture change associated with normal pile crush is a characteristic of all carpet and is not covered under this warranty. Texture retention is measured using the standardized rating scale CRI TM 101, with a rating scale of 5.0 (new carpet, or no change) to 1.0 (severe change). To perform as warranted, your carpet must retain a texture retention rating no less than 2.5 under the warranted conditions. Improper or inadequate care and maintenance will accelerate changes in carpet appearance and are not warranted. What Is Not Covered?”

Bliss Serenity Indulgence PermaSoft Solution Dyed Nylon Lifetime No Exclusions Stain Warranty Your Bliss Indulgence™ carpet is WARRANTED AGAINST ALL HOUSEHOLD STAINS for the lifetime of your carpet. is warranty requires you to clean your carpet as outlined elsewhere in this warranty guide. Bliss Indulgence PermaSo Solution Dyed Nylon carpets are protected by Scotchgard Protector. A toll free 800-550-6033 phone number is dedicated to assist you with carpet care and stain removal needs, and to obtain related warranty service. No claim will be considered if you do not have receipts as proof of professional hot water extraction cleaning performed at least once every 18 months, starting from the date of original purchase. Failure to do so voids these warranties. Stain claims are limited to one replacement and the replacement carpet is not covered under this stain warranty. is warranty is not transferable and is not pro-rated for the first five (5) years. COVERAGE

This limited warranty covers manufacturing defects and loss of original pattern and color due to stain, fade or wear, provided that the LVF covered by this limited warranty is (i) installed and maintained according to the Beaulieu Installation Instructions and (ii) subject only to normal residential, light commercial use or commercial use, as further detailed for any individual warranties for a specific LVF product as noted below. Page 2 | 5 WARRANTY GUIDE FOR LUXURY VINYL FLOORING Residential warranties apply to products installed in non-commercial, owner-occupied, residential premises (single family homes, condominiums, town houses, etc.). Residential rental units fall under the commercial or light commercial warranty only. 1. MANUFACTURING DEFECTS Beaulieu warrants to the original purchaser of its LVF products that, if properly installed, the products shall remain free of manufacturing defects for the indicated period of time, starting from the date of original purchase, as long as the original purchaser owns the property. The product will be manufactured according to the floor covering industry’s standards and tolerances in quality variation. Beaulieu will replace or repair defective materials including reasonable labor costs during the first five (5) years from the date of the original purchase. If the owner hires a third party to install the product, the owner is responsible for that party’s judgment. Material installed with obvious defects will be deemed acceptable by the owner or installer and will not be considered for warranty. This warranty is subject to restrictions and limitations outlined in the Conditions/Exclusions and Limitations sections.

 WEAR, STAIN AND FADE WARRANTY Beaulieu warrants to the original purchaser that its LVF products will not wear, stain or fade from normal use for the indicated period of time specified on the authorized Beaulieu retailer’s sample, starting from the date of original purchase. This warranty is subject to restrictions and limitations as outlined in the Conditions/Exclusions and Limitations sections of this document. Definitions: “Wear” must be through the wear layer to the degree that the printed pattern is altered. “Fade” must be to the degree that the floor is permanently discolored. “Stain” is defined as a permanent change in color of the surface of the product caused by common household food, beverages and recommended cleaning products as indicated in our Care and Maintenance Guide.

CONDITIONS/EXCLUSIONS The residential limited warranty is not transferable and applies only to the original purchaser of the Beaulieu LVF product, not to any subsequent owner or user of such product, regardless of how such ownership or use arises. The commercial limited warranty is not transferable and applies only to the original purchaser of the Beaulieu LVF product, not to any subsequent owners or users of such product, regardless of how such ownership or use arises. Copies of the original sales receipt must be maintained. This warranty applies only where the affected area of the Beaulieu LVF is visible and covers an area greater than 10% of the room. The following are not covered by this limited warranty: • Claims arising out of scratches and dirt. Some products tend to show more scratches and dirt due to color and may require more maintenance. • Shading claims for an overall white product that touches another white plank or tile floor covering. • Damage caused by improper installation (including but not limited to improper adhesives and improper subfloor preparation as outlined in the Beaulieu LVF Installation Instructions). • Damage caused by exposure to extreme heat, freight, accidents, intentional abuse, misuse, improper care and maintenance, vacuum cleaner beater bar, indentations, improper rolling loads, use of chairs or other furniture without proper floor protectors or caster wheels, cuts, surface scratches, impact, changes in color or sheen appearance when exposed to a natural light source, subfloor conditions, fire or smoke damage, flooding caused by natural disaster, water or liquid intrusion (including pet urine), Page 3 | 5 WARRANTY GUIDE FOR LUXURY VINYL FLOORING exterior application or modification, alterations, repair or service by a non-authorized third party, or construction-related damage. • Minor shading, color or texture differences between samples and delivered product, all of which will be determined at Beaulieu’s sole discretion. • Damage arising out of the use of Beaulieu LVF products to seal an existing subfloor from moisture, as Beaulieu LVF products will not inhibit the growth of mold associated with or caused by flooding, excessive moisture, hydrostatic pressure or alkalis found within a subfloor. • LVF products used for athletic playing surfaces or any type of recreational activity. • LVF that has been cut or altered; any installation of the wrong style, color or product with visible defects. Visible defects include but are not limited to shading, surface sheen, squareness, and product color. Labor is excluded on products installed with visible defects. • Damage from neglect, pets, pebbles, other abrasives, insects, spike-heeled shoes, or improper maintenance. • Discoloration or expansion from heat or sunlight. Avoid exposure to long periods of sunlight. Beaulieu requires the use of UV protective film, blinds, curtains or shades to assure that LVF products are protected from sun and are not overheated due to this exposure. This type of exposure can induce expansion which may cause buckling. Flooring that cannot be protected from direct sunlight is required to be installed with adhesive. Failure to install this LVF with Beaulieu approved adhesive when such flooring will be exposed to direct sunlight voids all warranties, express or implied; furthermore, the end user shall assume full responsibility for any failure of the flooring, and Beaulieu shall be released from any claims, damages, or liabilities whatsoever arising out of or related to the failure to install the flooring with approved adhesive when the flooring is exposed to direct sunlight. • This limited warranty is void if (i) prior to installation, Beaulieu LVF products are not acclimated to room temperature, between 65 °F - 85 °F (18.3 °C - 29.4 °C), at job site for 48 hours, or if (ii) postinstallation, Beaulieu LVF products are not continuously maintained at a temperature between 65 °F - 85 °F (18.3 °C - 29.4 °C). • Normal wearing of the finish in high traffic areas, pivot points, and seating areas. • Beaulieu cannot guarantee a perfect match between productions. Production runs are dye lot sensitive. There may be minor differences in color and texture between the dealer’s sample and the finished material and from one lot to another. • Moldings and accessories.

Engineered Flooring 

COVERAGE

5 WARRANTY GUIDE FOR ENGINEERED WATERPROOF FLOORING

Services

Your Floor offers a one year labor warranty on its flooring work. The warranty voids if: the flooring is water damaged or has high moisture levels. Furthermore, the warranty is not liable for any scratches or normal wear the floor might accumulate in time. All repairs or claims will require an official notice sent to our office located at 4183 Northeast Expressway, 210, Atlanta, GA 30340. All products claims must be submitted to the manufacturer of the product. 

Refund Policy 

All sales are final, No refund. 

Terms and Conditions

Term. Unless the Service Contract states otherwise, the term of the Service Contract commences upon Acceptance Date of the Services and continues for the time period indicated in the Service Contract unless terminated early in accordance with these Terms and Conditions (the “Term”). Contractor shall notify Customer when Services have been delivered to Customer and Customer shall have 5 days to accept Services or to give contractor notice that it does not accept Services, otherwise Services are deemed to be accepted. At expiration, the Term will automatically renew for successive renewal terms of one (1) year each, unless either Empire Access or Customer gives written notice to the other of its election not to renew the Term at least thirty (30) days before the expiration of the then-current Term.

Rates and Charges. The rates and charges for the Services are as set forth in the Service Contract. All rates and charges set for in any quote are subject to final approval by Contractor. Contractorwill invoice Customer for all non-recurring charges and monthly recurring charges at the time of service installation, with monthly recurring charges billed at the beginning of the month and usage charges billed at the conclusion of the month. All bills are due and payable upon receipt. If Customer does not pay the amount due within 30 days of the invoice date, Customer shall pay a late fee of 1.5% per month on the unpaid balance.

Termination. (a) Either party may terminate the Service Contract upon written notice to the other party if (i) the other party dissolves or becomes insolvent or bankrupt, or (ii) any bankruptcy, reorganization, insolvency or similar proceeding is instituted by or against the other party and not dismissed within thirty (30) days, (iii) the other party makes an assignment for the benefit of creditors; (iv) the other party suspends the transaction of its usual business or consents to the appointment of a trustee or receiver; or (v) a trustee or receiver of the other party is appointed.

Warranty. THE QUALITY OF SERVICES PROVIDED HEREUNDER SHALL BE CONSISTENT WITH COMMON CARRIER INDUSTRY STANDARDS AND APPLICABLE GOVERNMENT REGULATIONS.  CONTRACTOR MAKES NO OTHER WARRANTIES ABOUT THE SERVICES, EXPRESS OR IMPLIED, INCLUDING ANY WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE, AND CUSTOMER MAY NOT RELY ON ANY STATEMENT TO THE CONTRARY BY ANY PERSON. THIS SECTION WILL SURVIVE THE EXPIRATION OR TERMINATION OF THE CONTRACT DOCUMENTS.
